Cloth. $120. * Haines' colorful history of the Supreme Court surrounding the John Marshall years gives particular attention to the "local, particularist and democratic" principles (Introduction, p.4) that Haines, an ardent Jeffersonian, believed were neglected in favor of a conservative and nationalistic viewpoint found in earlier histories of the Court. He shows that the Supreme Court under Chief Justice John Marshall established the doctrine of judicial review as part of a Federalist effort to strengthen the central government, and goes on to discuss attacks upon the Court and the decline of authority and prestige of the Court. In his description of the Court's major decisions, he examines the issue of state versus national sovereignty and the status of common-law principles in the federal courts. He includes a discussion of opinions regarding the Dartmouth College case and the trial of Aaron Burr. Haines was a political scientist and professor of Political Science at the University of California at Los Angeles for twenty years.
