New York Civil Practice

The term "civil litigation" denotes the process and procedure necessary to adjudicate a dispute between two individuals, arising from a private injury. This definition contrasts civil litigation from criminal litigation, in which the injured party is society at large whose interests are represented by the government. In New York, the rules and regulations governing civil disputes are contained in theNew York Civil Practice Law and Rules(hereinafter referred to as theCPLR). These statutes establish all of the regulations and requirements for litigating a civil matter in the New York state court system. If the dispute is one that can or must be adjudicated in one of the federal courts that sits in New York, the governing statutes are the Federal Rules of Civil Procedure (litigation in the federal courts in New York is discussed in Chapter Eight).
