SUMMARY

It is my hope that this textbook can be useful to educators in a variety of ways. At St. Petersburg Junior College, it is intended for students who have successfully completed an introductory course in civil litigation. It provides students with a practical application of the theories they learned from the first semester. If civil litigation is not offered as a two-semester topic, it can be used as a stand-alone text to teach civil litigation. It can also be used as a trial practice text. I expect that it will have other possible applications as well, depending upon the curriculum at the various schools across the country. The book's premise involves two students who have successfully completed a legal studies program and are beginning to work on their first case in a law office. One student works for a arm that handles only plaintiff cases; the other works for a defense law firm. The text is presented from the perspective of each student. This book offers students an opportunity to develop and analyze a trip-and-fall case. The first chapters address pretrial activity, and the later chapters concentrate on the trial proceedings, testimony, and dialogue. Acting as a jury, the class will vote to determine the outcome of the case. The rules of procedure in the fictitious state of Atlantis will differ from the rules of some other states. I suggest that students compare their jurisdiction's rules of procedure to those of Atlantis. I intended to provide students with a practical example of what to expect in a law firm that handles civil litigation cases in general, and personal injury cases in particular.
